Terms of Service

ArchTx provides a construction technology platform for plan discovery, professional matching, project coordination, milestone supervision, escrow-supported payments, and dispute workflows.

By accessing or using the platform, you agree to these terms. If you use ArchTx on behalf of a company, trust, chama, estate, or other organisation, you confirm that you have authority to bind that organisation.

ArchTx makes tools available for browsing plans, purchasing plan licences, onboarding professionals, managing project milestones, coordinating communications, recording approvals, and reviewing disputes.

Professionals remain responsible for their own licences, regulatory registrations, workmanship, advice, deliverables, tax obligations, and compliance with applicable project agreements.

BuildSafe escrow workflows support milestone-based payment release. Funds are released only after the applicable project approval, supervisor verification, or dispute outcome is recorded.

ArchTx may charge platform, verification, supervision, payment processing, or dispute administration fees disclosed during checkout or project setup. Payment providers may apply their own terms.

Escrow arrangements do not create a deposit-taking, banking, or investment relationship with ArchTx. Each project may include separate payment terms that apply in addition to these terms.

ArchTx, its software, brand assets, workflow content, and platform materials are owned by ArchTx or its licensors. Users may not copy, reverse engineer, resell, or exploit the platform except as allowed by these terms.

Architectural plans, drawings, specifications, photographs, and project documents remain owned by their creator or lawful owner unless a written transfer says otherwise. A plan purchase grants the licence shown at checkout, usually for one build on one plot.

Parties should first use the platform's evidence and dispute tools to attempt resolution. ArchTx may facilitate review, request documents, freeze milestone releases, or issue a platform decision where the project terms allow it.

If a dispute is not resolved through the platform process, it will be referred to arbitration seated in Nairobi, Kenya, unless the parties agree otherwise in writing. The language of arbitration will be English.

To the maximum extent permitted by law, ArchTx is not liable for indirect, incidental, special, punitive, or consequential losses, or for loss of profits, revenue, goodwill, data, or business opportunity.

ArchTx's total liability arising from the platform or these terms is limited to the platform fees paid by you to ArchTx for the affected service in the twelve months before the claim.

These terms, the platform, and related non-contractual obligations are governed by the laws of the Republic of Kenya.

Subject to the arbitration clause, the courts of Kenya have jurisdiction over proceedings related to these terms.
